Template from EsigIt (esigit.com), October 2026. A starting point, not legal advice. Waiver rules differ by state: some states void releases for personal injury, and rules for minors vary. Have a lawyer in your state review it before you rely on it.

What should a liability waiver include?

A clear waiver names 6 things: who's protected, the activity, the real risks, the participant's choice to accept them, the release of claims, and a plain statement that they're giving up rights.

Specific risks beat boilerplate. "Falls from the climbing wall" shows what the participant knew. "All risks" shows nothing. Keep the words plain and the type readable. This template was written in October 2026 with blanks for each of the 6.

What's the difference between a waiver and a release of liability?

They overlap, and this template combines 3 parts: a waiver gives up a right ahead of time, a release lets go of claims, and assumption of risk says the participant accepted the dangers.

Most forms people call a waiver do all 3. That's why the title on this one names all 3.

Are liability waivers enforceable in every state?

No: Louisiana's Civil Code article 2004 voids any clause that excludes or limits, in advance, liability for causing physical injury to the other party.

The same article voids clauses that excuse intentional or gross fault, and this template doesn't try to release either one. Rules for waivers a parent signs for a child differ from state to state. If people can get hurt doing what you run, have a local lawyer read your waiver. That's an hour of their time against a lawsuit. Checked October 2026.

Are online waivers legal?

Yes: the federal ESIGN Act of 2000 says a signature can't be denied legal effect just because it's electronic, so an e-signed waiver stands on the same footing as a paper one.

The same law doesn't require anyone to agree to sign electronically, so keep a paper copy for the participant who asks. EsigIt records each signer's consent and checks them with a 6-digit code sent to their email. Read more on what makes an e-signature hold up.

When is EsigIt the wrong tool for waivers?

EsigIt sends 1 document to the people you name by email, so it's the wrong tool for a front desk that collects waivers from walk-ins all day.

Each signed waiver is $1.99. That's right for a 12-person class, a rental, a volunteer day or a single job. For a busy gym or trampoline park, a waiver app with a kiosk mode and one reusable link is built for that job. Use one.

How do you send this waiver for signature with EsigIt?

It takes 4 steps, and EsigIt charges $1.99 when the participant, and the parent if there is one, have signed.

  1. Fill in your part. Download the PDF or copy the text into Word or Google Docs, fill in every red [BRACKET] that's yours, and save it as a PDF.
  2. Upload it to EsigIt. Or press Send it for signature to start from the blank template and add a text field for each blank your client fills in.
  3. Add who signs. Type each signer's name and email, then drag the signature and date fields onto the signature lines.
  4. Send. Your client opens the link, enters a 6-digit code EsigIt emails them, reads the whole document and signs on their phone. You both get the signed PDF.

This is not legal advice. The template is a starting point. Waiver enforceability varies by state: some states void releases for personal injury, and rules for minors differ. Have a lawyer in your state review it before you rely on it.

What else do people ask about this waiver?

4 short answers, current as of October 2026.

Is this liability waiver free?
Yes. Copy it, download the PDF, print it and edit it. You pay EsigIt $1.99 only if you send it through EsigIt and it's signed.
Can a parent sign for a child?
The form has a parent or guardian line for that. Whether a parent's signature can waive a child's own claim depends on your state, so ask a local lawyer if you run youth activities.
Does each participant need their own waiver?
Yes. One waiver per participant keeps each person's signature, date and health answer separate. With EsigIt that's $1.99 each.
Can I add a photo release?
You can. Give it its own checkbox or initials line, so agreeing to photos is a separate choice from the injury release.
